These Terms of Service ("Terms") govern your use of the Traedi platform and its associated services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Account Registration
To use the Service, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account login information and are liable for all activities that occur under your account. You may not share your account login information with third parties or use another user's account without their permission.
Use of Service
You may use the Service for its intended purpose, which includes job management, scheduling, quoting, invoicing, and payment processing. You may not use the Service for any illegal or unauthorized purpose, or in a manner that violates these Terms or any applicable laws or regulations.
Intellectual Property
Traedi retains all rights, title, and interest in and to the Service, including all intellectual property rights. You may not reproduce, modify, distribute, or create derivative works based on the Service without Traedi's prior written consent.
User Content
Users are solely responsible for the content they post or upload to the Service, including text, images, and other materials ("User Content").Users retain all rights to their User Content and grant Traedi a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute their User Content for the purposes of providing the Service.
Prohibited Conduct
You may not use the Service to engage in any conduct that is harmful, illegal, or disruptive to the Service or other users, including but not limited to:
- Posting or uploading content that is defamatory, obscene, or offensive;
- Using the Service to distribute malware or other harmful software;
- Impersonating another person or entity; - Interfering with the operation of the Service or attempting to gain unauthorized access to the Service or its systems.
Termination
Traedi may terminate or suspend your access to the Service at any time, without notice or liability, for any reason, including but not limited to a breach of these Terms.
Disclaimer of Warranties
The Service is provided 'as is' and without warranty of any kind, whether express or implied, including but not limited to any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
Traedi shall not be liable for any indirect, incidental, special, or consequential damages arising from or relating to your use of the Service, including but not limited to lost profits or data, or damages resulting from any errors or interruptions in the Service.
Indemnification
You agree to indemnify and hold Traedi harmless from and against any claims, damages, liabilities, and expenses arising from or relating to your use of the Service or any User Content you post or upload to the Service.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of Queensland, Australia, without giving effect to any principles of conflicts of law. Any legal action arising from or relating to these Terms shall be brought in the state or federal courts located in Queensland, Australia.
Amendments
Traedi may amend these Terms at any time by posting the amended Terms on the Service. Your continued use of the Service after any such amendments shall constitute your acceptance of the amended Terms.
Entire Agreement
These Terms constitute the entire agreement between you and Traedi regarding the use of the Service, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Traedi.
